These Terms of Service (“Terms”) govern your use of Somerset Technology Sale’s website and all services we provide, including purchasing, selling, trading, recycling, ITAD services, logistics, and UPS power solutions (“Services”). By accessing our website, submitting information, or engaging with our Services, you agree to these Terms.

If you do not agree, please discontinue use of our website and services.

 

1. Services Provided

 

Somerset offers a range of IT hardware and lifecycle services, including but not limited to:

Hardware sales (servers, storage, networking, laptops, desktops, components, UPS systems, etc.)

Buyback and trade-in programs

IT Asset Disposition (ITAD), including DoD-compliant wiping and physical destruction

Electronics recycling with EPA-compliant downstreams

Project logistics, staging, kitting, palletizing, and freight coordination

UPS sizing, battery replacement, installation, and maintenance

Somerset may update or modify Services at any time.

 

2. Quotes, Pricing & Availability

 

All quotes (“RFQs”) provided by Somerset are:

Based on available inventory at the time of the quote

Valid only for the timeframe listed in the quote

Subject to change based on condition, market price, testing, or final inspection

Somerset is not responsible for delays or changes caused by suppliers, carriers, or circumstances outside of our control.

 

3. Orders & Payment

 

Payment terms are specified on each invoice and may include ACH, check, or other approved methods.

By placing an order, you confirm that:

All information you provided is accurate

You are authorized to make the purchase

You will pay all fees, taxes, shipping charges, or other costs listed on the invoice

Somerset may cancel orders for fraud concerns, inability to verify information, or insufficient inventory.

 

4. Condition of Equipment

Somerset sells equipment that may be:

New

Open-box

Refurbished

Used

Specialty or legacy hardware

Condition, testing status, and included accessories are specified on the quote or invoice.
Unless stated otherwise, all equipment is sold as-is with no implied warranty.

Optional warranties may be offered on select hardware.

 

5. Returns, RMAs & Refunds

 

Return eligibility is determined by the RMA policy on each invoice or product listing.

In general:

RMAs must be requested within the stated return window

Returned items must match the serial numbers shipped

Physical or user-inflicted damage is not covered

Refunds or replacements will be processed after inspection

Shipping costs are non-refundable unless otherwise stated.

6. Selling Equipment to Somerset (Direct Purchase)

 

When you sell equipment to Somerset:

All equipment must match the descriptions, configurations, and conditions represented

Somerset may adjust the offer if equipment differs upon inspection

You confirm that you legally own the equipment and are authorized to sell it

Payments are made according to agreed terms after intake and verification

Misrepresented or stolen equipment will be reported and returned or held pending investigation.

 

7. Trade-In & Value Recovery

 

Trade-in credits are applied only:

After equipment is received and inspected

If models, specs, and conditions match the submitted asset list

If trade-in terms are confirmed in writing

Somerset may decline trade-in items that do not meet market, condition, or compliance requirements.

8. ITAD, Data Destruction & Recycling

 

By using Somerset’s ITAD or recycling services, you acknowledge:

Wiping and destruction follow DoD and industry-standard methodologies

Certificates include serial numbers, timestamps, and destruction/erasure methods

Non-viable equipment is routed to certified, EPA-compliant downstreams

You are responsible for removing or backing up all data before pickup unless otherwise agreed

Somerset is not liable for lost data, missed backups, or data that was not disclosed to us.

 

9. Logistics, Pickup & Freight

 

For logistics projects, you agree to provide accurate:

Equipment counts

Site access details

Dock/lift-gate requirements

Deadlines and scheduling constraints

Delays caused by incorrect information, site inaccessibility, or unsafe conditions may incur additional charges.

Freight timelines are estimates and may vary based on carriers and external factors.

 

10. Acceptable Use of Website

 

When using our website, you agree not to:

Attempt to breach security or access restricted areas

Scrape or harvest data without permission

Upload malicious files

Misrepresent your identity or authorization

Somerset reserves the right to restrict website access for misuse or violations.

 

11. Limitation of Liability

 

To the fullest extent permitted by law, Somerset is not liable for:

Indirect, incidental, or consequential damages

Loss of data, revenue, or downtime

Delays caused by carriers, third parties, or conditions outside our control

Issues arising from inaccurate information provided by the customer

Our total liability is limited to the amount paid for the specific service or product in question.

 

12. Indemnification

 

You agree to indemnify and hold Somerset harmless from any claims arising from:

Misrepresented equipment

Improper data handling prior to pickup

Violation of these Terms

Illegal or unauthorized use of our services

 

13. Changes to These Terms

 

Somerset may update these Terms at any time. Changes become effective when posted on this page.
